On June 3, 2009 Minneapolis-St. Paul Star Tribune writer Jenna Ross reported “Yahoo! Sues for fantasy football info.” According to Ross’s report, “In 2007, the Eighth U.S. Circuit Court of Appeals decided that CBC Distribution and Marketing Inc. could use Major League Baseball players’ names and statistics for its fantasy baseball products — without paying a fee. The U.S. Supreme Court elected not to review the case.” So the question is whether or not Yahoo!’s fantasy football lawsuit will play out like CBS’s fantasy baseball case.  One thing Yahoo! has in its favor, states Ross, is that the suit has been filed in Minnesota where U.S. District Judge Ann Montgomery ruled against the NFL Players Association and for CBS.

Mike Floria of ProFootballTalk.com posted this in the early morning on June 4, 2009, “Essentially, Yahoo! is seeking a judicial declaration that its intention to operate a fantasy football game in 2009 without paying fees to the NFLPA is legally appropriate.  And, barring something unforeseen, Yahoo! likely will prevail.” However, just a little more than four hours later Floria, after a deeper investigation of Yahoo!’s suit changed his tune. “And, as it turns out, the lawsuit attempts not only to utilize without compensation the names of the players, but also likenesses (including, without limitation, numbers), pictures, photographs, voices, facsimile signatures and/or biographical information (including but not limited to player statistics),” Floria writes in his post. “In our view, if Yahoo! wants to enhance the basic name-and-stats fantasy experience, Yahoo! probably should have to pay for the ability to use likenesses, pictures, voices, etc,” he concludes.

Everyone is Talking About Fantasy Sports, Even Academia!

The Ludwig von Mises Institute is an intellectual hub with educational and research facilities located in Auburn Alabama, but even they are talking about the Yahoo! case. Mises Economics Blog contributor S.M. Oliva stated on June 4, 2009, “Not all intellectual property involves copyrights, patents, or trademarks. Many states recognize a ‘right of publicity’ that allows a person — or in some cases a decedent’s estate — to control the use of one’s name, likeness, and image for commercial purposes.” Oliva then clarified the Yahoo! lawsuit’s main question, “Are player names, information, and statistics the “intellectual property” of the players vis-à-vis the right of publicity?” So what will the answer be? Here are some things to consider:

–The First Amendment has been found to supplant the “right of publicity”

–The Federal copyright law may supersede the assertion that player names, stats and other info are the intellectual property of the NFLPA

–Sports leagues and Player’s Associations have the right to build and market their own fantasy games if they wanted a larger piece of the market

–A player does not create individual statistics; stats are a quantification of events that have already occurred.

So what will the outcome be? We will just have to keep watching, but Oliva says it best, “Fantasy sports haven’t taken away from the pie; they’ve made it bigger for everyone.”

That being said, we can now turn to the question of role models. Is it acceptable for athletes, in this case pro NFL players, to be role models? The answer should be a resounding yes. Physical skills and prowess, while perhaps not as significant as their mental counterparts, are still characteristics to which we should aspire. Who would want to take away the goal of a high school student to rush for as many touchdowns as his favorite pro NFL running back? Is this a poor aspiration for the young man? Is it detrimental to his development towards manhood? Of course not. Where the problem lies is not with the pro NFL players’ skill on the field, but with their behavior off of it. This is where most people fail to make an important distinction, and it is this: A pro NFL player is a role model as an athletic figure. Period. His actions off the field do not fall into that realm. Admire pro NFL athletes for the physical prowess they embody. Make your own decisions and choose your own actions. As long as you remember to keep the two separate, you will be just fine.

So, I gave him the money. He then quickly spent all of the money I gave him and went out of business. I never heard from him again. That taught me a very valuable lesson. If I want to make money in business, I must become an expert at business.

I’ve watched many other NFL players become victims of unwise business investments. This includes business people coming to them asking for investment money to start entertainment businesses, restaurants, clothing lines, clubs, and more. In nearly every instance, the NFL player lost every cent of money he invested to help start a business.

As I have studied business and become successful at it, I have developed some rules that I live by when starting a new business.

1. There is no such thing as easy money. Starting a business takes time and it is hard work. To be successful at business you must be patient and conservative with your money. As a rule of thumb, triple what you think expenses will cost and divide by three the money you think you will make. By doing that you will have a more accurate picture of how a business will perform in its 2-3 years.

2. When getting involved in business, only get involved in a business you are very passionate about. You must love the business you are in. And, you must be very educated about the business you are getting involved in. Don’t just blindly spend money starting a new business for which you have no experience. You must learn everything you possible can about running that type of business before you invest your money. If possible, get a job working in a very similar business so you can learn all there is to know about running that type of business. See if there are books written about the type of business you want to start and study them over and over. Also, talk to other business owners who run the type of business you want to start. Ask them for tips and the best way to run that type of business. Maybe you can hire them as a consultant to help you start your business. The more knowledge you can gain before you start a business, the better chance you have of making your business successful.

3. Look at your financial situation. Do you have enough money in savings to cover all of your personal and business expenses for at least one full year? If you do not, you are asking for trouble. Nearly all businesses do NOT make a profit their first year in business. If you expect the business you start to immediately generate a lot of money, you are in for a huge disappointment. Again, you must be very conservative with your money.

4. Find a good accountant who will help you with tax planning. If you can, find an accountant who has experience doing accounting for the type of business you want to start.

5. The most important thing you can do is find a successful business mentor. I continued to be unsuccessful in business until I found a business mentor (Peter Geisheker) who helped me with every aspect of running my business. I started an online store to sell NFL merchandise (mcsportsfan.com). Peter is an expert at Internet marketing and ecommerce and he taught me all the ins and outs of successfully running an online business. He has also helped me save a lot of money as I was spending a small fortune on Internet services that I did not need. Now that I am working with Peter, I am making money instead of losing money and I am having a lot of fun in business. Again, I cannot stress how important it is for you to find an honest and successful business mentor to guide you through building and managing your business.

Another team may like how well a player performs and want him for their own team. A second reason why an NFL player might switch to another team is because he likes the other team better. He may have played college football with members on the team he wishes to switch to, or he simply likes the way the other team’s players perform. The coach may be easier to deal with, too. It is quite important for coaches and their players to have a good rapport and good communication, and if they don’t, it can cause various problems.

Additionally, the NFL player who wishes to switch teams may simply not get along with his teammates. This is not unusual. Football is all about team work, and if team members can’t get along or agree on things, then they will most likely play poorly when out on the field together. Working as a team is essential if the players want to win games and Super Bowls. So, if the NFL player would be a better fit on another team, and the coach and other team members agree, then it is probably better that the team member switch..

One of the questions people always ask me about being an NFL player is, “what is it like making so much money at such a young age?”

I have to say that it is very difficult to go from being young and having no money to being young and a millionaire because you do not know how to be financially responsible. It’s just like winning the lottery, and as you know from reading about lottery winners, most lottery winners go broke within 10 years after winning the lottery. Well, it is not that much different with professional sports players. The reason for this is most professional athletes, and lottery winners, were never taught money management skills. Going from being broke one day to being a millionaire the next day is a huge change in your life, mostly because once you have money, everybody wants you to give it to them, and most of the time you do.

I came from a single family home without a father, which is something many professional NFL players have in common. I am also African American and my family did not have a lot of money, which is also very common among NFL players. Because of this, I was never taught how to manage money responsibly and plan for my future. I went from being broke one day to being drafted into the NFL and becoming a millionaire.

A huge problem with being young and having a lot of money is the pressure by just about everybody including fellow players to spend a lot of money very quickly. When you are rich, everybody wants your money, especially your family and friends. My mother, aunts, uncles, cousins, friends, etc. all wanted to borrow money from me. And of course I gave it to them. Then, you have girlfriends and wives who want you to buy them lots of expensive presents like cars, jewelry and clothes because you are rich and they want to show off to their friends. You also have charities, investors, and businesspeople all asking for your money-and you end up giving it to them.

But possibly the worst of all is the other players because when it comes to money it is the blind leading the blind. We all spend our money as if it will never run out because we are uneducated in financial responsibility. For example, for you to be cool and respected by the other players, you have to keep up with them. So, if one player buys a new SUV, you want to buy one too. I mean, you can’t be an NFL player and drive a normal car like a Honda Civic. You have to drive an expensive Hummer, Cadillac Escapade, BMW, Mercedes, Porsche, etc.

You also have to have a huge expensive house. All the other players do and if you just live in an average house, they look down at you. So, we spend a fortune buying huge houses for ourselves and for our parents that we do not need. And of course there is the jewelry. We spend so much money on jewelry it is insane. It is nothing for a player to spend 0,000 a year or more buying jewelry, and that is just for us. That does not include all the jewelry we buy for our family, wives, and girlfriends. It is all extremely irresponsible. But, when you have so many people putting pressure on you every day to buy things and keep up with the other NFL players, it becomes much easier to say yes than to say no, even as you are watching all of your money disappear.

Another problem is as a wealthy NFL player, you are expected to flip the bill for everything. Whenever you go out to restaurant, you are the person who pays for everybody. And, when you go out with other players or your buddies, it is always to a fancy club where we go to the VIP section and spend thousands of dollars on fancy champagne and drinks-for everybody. I have known players who have spent over ,000 in one night at a club. And then they go and do it over and over so they can be the “big man.”

Another problem NFL players have is women who are after us for our money and our status. And many of these women are gold diggers. If we were not rich athletes these beautiful women would probably not look twice at us. But now that we are rich and well known, women chase us constantly. This almost always leads to us marrying a woman we shouldn’t marry and then getting divorced after a couple of years and losing a large percentage of our money in the divorce. I made this mistake myself and it cost me dearly and still costs me.

In close, being a wealthy athlete is much more difficult than people think because there is so much pressure on us to spend our money as quickly as possible. Money magnifies problems, it does not eliminate them as most people think it does.

How To Become An Nfl Player

In this article I am going to discuss the specific football drill skills you need to develop to make you look attractive to college football scouts. For maximum results, I recommend that you work on these drills with a strength coach or a professional trainer.

Here are the drills you need to master:

* Vertical Jump – designed to test leg strength and lower-body explosiveness.

* Broad Jump – designed to show sluggishness, heavy-leggedness and lack of explosiveness.

* 225-lb. Bench Press – designed to test the upper-body strength of a player.

* 40-Yard Dash – times show how explosive a player is off the line and how he maintains it.

* 20-Yard Dash – times show how explosive a player is off the line and how he maintains it.

* 10-Yard Dash – times show how explosive a player is off the line.

* 20-Yard Shuttle – designed to test explosiveness, how a player bends and changes direction, and body control.

* 60-Yard Shuttle – designed to test explosiveness, flexibility, and body control; and a subtle test of endurance.

* 3-Cone Drill – designed to test a player’s efficiency in changing direction moving left and right, explosiveness, balance, body control and mobility.

The most important skills to master are the 40-yard dash and the 3-Cone drill. The reason these two drills are so important is they help football coaches determine what positions you are best suited to play.

You should know that the speed players are completing these drills has been improving every year. This is because more and more high school and college players are working with professional sports trainers to help them maximize their performance.

Below I have listed the minimum times you need to have by position if you want to impress college football scouts. One thing to keep in mind for these tests is the size of the player. Smaller players should have an advantage over their bigger counterparts in regard to speed. If you are a big player, it says a lot about your athletic ability if you perform well in these drills.

40-Yard Dash:

QB: 4.7 seconds or faster
RB: 4.5 seconds or faster
WR: 4.4 seconds or faster
FB/TE: 4.7 seconds or faster
OL: 5.2 seconds or faster
DT: 5.1 seconds or faster
4-3 DE and 3-4 OLB: 4.8 seconds or faster
4-3 OLB: 4.7 seconds or faster
ILB: 4.7 seconds or faster
S: 4.5 seconds or faster
CB: 4.5 seconds or faster

3-Cone Drill:

QB: 7.1 seconds or faster
RB: 7.1 seconds or faster
WR: 7.0 seconds or faster
FB/TE: 7.2 seconds or faster
OL: 7.8 seconds or faster
DT: 7.7 seconds or faster
4-3 DE and 3-4 OLB: 7.2 seconds or faster
4-3 OLB: 7.1 seconds or faster
